Scoop Dog Terms of Service SNOW REMOVAL

1. Weather Limitations

Scoop Dog is not responsible for delays or incomplete service caused by severe weather conditions, road closures, or government-declared emergencies. Service times may vary depending on storm intensity and route order.

2. Ice and Slippery Conditions

Scoop Dog will remove snow as contracted but cannot guarantee that all surfaces will remain completely free of ice or slippery conditions. The client understands and accepts that ice can reform due to temperature changes, melting, refreezing, or ongoing precipitation. Scoop Dog is not liable for slips, falls, or accidents occurring after service completion.

3. Damage Disclaimer

While all reasonable care will be taken, Scoop Dog is not responsible for damage to:

  • Concrete, asphalt, interlock, or landscaping caused by pre-existing cracks or defects.

  • Items left within the work area (e.g., cords, garden decorations, hoses, or lawn ornaments).

  • Driveway markers, curbs, or sod displaced by plowing or shoveling due to hidden obstructions.

4. Indemnification

The client agrees to hold harmless and indemnify Scoop Dog, its employees, and contractors from any claims, damages, losses, or expenses (including legal fees) arising out of performance of the snow removal services, except in cases of proven negligence or willful misconduct by Scoop Dog.

5. Service Timing

Scoop Dog will strive to complete snow removal within 6–12 hours after snowfall ends. However, timing may vary due to storm length, intensity, or road conditions. Priority is given to safety and route scheduling.

6. Liability Limitation

Scoop Dog’s total liability for any claims related to this agreement shall not exceed the total amount paid by the client for services rendered during the current season.

7. Property Access

The client must ensure the property is accessible at all times. Failure to move vehicles, remove obstructions, or provide gate access may result in skipped service or rescheduling. Missed visits due to inaccessibility are still billable.

8. Service Suspension

Scoop Dog reserves the right to suspend or delay service if:

  • Conditions are unsafe for equipment or staff (e.g., freezing rain, visibility under 20m).

  • Invoices remain unpaid beyond 10 days.

  • Access to the property is repeatedly obstructed.

9. Cancellation Policy

Either party may terminate this agreement with 7 days’ written notice.
If terminated mid-season, the client will be billed at the per-visit rate for all services completed to date.

10. Governing Law

This agreement shall be governed by the laws of the Province of Ontario, and any disputes shall be resolved in the City of Ottawa, under the jurisdiction of Ontario courts.

11. Entire Agreement

This document represents the entire understanding between Scoop Dog and the client. No other verbal or written agreements are valid unless signed by both parties.
